Acceptance of Terms

By accessing or using statusfox.app or the StatusFox monitoring service, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our website or service.

In these Terms, "we," "us," and "StatusFox" refer to the operator of statusfox.app. "You" and "user" refer to the individual or entity accessing or using the service. "Service" refers to the StatusFox website and the StatusFox uptime monitoring service.

These Terms constitute a legally binding agreement. Please read them carefully before using the Service.

Service Description

Current State

StatusFox currently operates an informational website at statusfox.app with a newsletter subscription service. Visitors can sign up to receive product updates and announcements about the StatusFox monitoring product.

StatusFox Monitoring Service

StatusFox is an uptime monitoring service that verifies website and endpoint availability from multiple geographic regions to eliminate false positive alerts. The monitoring service includes the following features:

• Multi-region uptime verification to confirm that downtime is real, not a regional network blip
• Response time tracking and historical performance data
• Incident alerting via email, webhook, and other notification channels
• Status pages for communicating service health to your users
• Dashboard for managing monitors, viewing uptime data, and configuring alerts

We reserve the right to modify, suspend, or add features to the Service at any time with reasonable notice where such changes materially affect your use of the Service.

Acceptable Use Policy

You are responsible for your use of the Service. By using StatusFox, you agree to the following:

• Authorization requirement: You must own or have explicit written authorization from the owner to monitor any target URL or endpoint. Using StatusFox to monitor systems you do not own or do not have permission to monitor is strictly prohibited.
• No interference: You must not use the Service to perform or facilitate denial-of-service attacks, stress testing without authorization, or any activity that intentionally degrades the availability of a target system.
• No exploitation: You must not use the Service to probe targets for vulnerabilities or to gather intelligence for exploiting security weaknesses.
• No spam: You must not use alert channels or notification features to send unsolicited communications to third parties.
• Legal compliance: You must not use the Service for any purpose that violates applicable law, regulation, or the rights of any third party.
• No infrastructure abuse: You must not attempt to interfere with, disrupt, or gain unauthorized access to StatusFox's infrastructure, servers, or systems.

Violation of this Acceptable Use Policy may result in immediate suspension or permanent termination of your access to the Service, without refund.

Account Terms

When you register for an account with the StatusFox monitoring service, the following terms apply:

• You must provide accurate, current, and complete registration information and keep it up to date.
• You are responsible for maintaining the security of your account credentials, including your password. StatusFox will not be liable for any loss or damage arising from unauthorized access to your account due to your failure to maintain account security.
• You are responsible for all activity that occurs under your account, whether or not you authorized it.
• You must notify us immediately at hello@statusfox.app if you become aware of any unauthorized access to or use of your account.
• You may not share your account credentials with others or create accounts on behalf of third parties without their authorization.

Free Tier Terms

StatusFox offers a free tier of the monitoring service with limited capabilities. The following additional terms apply to free tier users:

• Free tier features, monitor limits, check frequency, and data retention limits may change at any time. We will provide reasonable notice of material changes that reduce free tier capabilities.
• StatusFox reserves the right to modify, suspend, or discontinue the free tier at any time with reasonable advance notice.
• No service level agreement (SLA) applies to the free tier. We do not guarantee any specific uptime or performance for free tier accounts.
• Free tier accounts may be subject to usage limits and rate restrictions designed to ensure fair use across all users.

Payment Terms

The following payment terms apply when paid plans are available:

• Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select.
• All fees are non-refundable except as expressly stated in these Terms or as required by applicable law.
• StatusFox may change subscription pricing at any time with at least 30 days advance notice to existing subscribers. Price changes take effect at your next renewal date.
• Failure to pay fees may result in suspension or termination of your access to paid features.
• You are responsible for all applicable taxes related to your use of the Service.

Limitation of Liability

To the maximum extent permitted by applicable law, StatusFox's sole liability and your exclusive remedy for any claims arising out of or relating to these Terms or the Service shall be limited to an extension of your subscription period by up to three (3) months. StatusFox does not provide monetary refunds, credits, or cash compensation of any kind.

IN NO EVENT SHALL STATUSFOX, ITS OPERATORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY MONETARY DAMAGES, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, LOSS OF BUSINESS GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF STATUSFOX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SOLE REMEDY IS A SUBSCRIPTION EXTENSION AS DESCRIBED ABOVE.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Disclaimer of Warranties

We work hard to keep StatusFox reliable and accurate, but no monitoring service can guarantee perfection. Network conditions, third-party infrastructure, and factors outside our control may occasionally affect results.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

While we strive for accuracy, monitoring results should be used alongside your own infrastructure tools and judgment. We recommend using StatusFox as one layer in your observability stack, not as the sole source of truth for critical decisions.

Intellectual Property

All content, features, and functionality of the Service, including but not limited to the website design, text, graphics, logos, and software, are owned by or licensed to StatusFox and are protected by applicable intellectual property law.

You retain ownership of all data you provide to the Service, including monitoring target URLs and configurations. By using the Service, you grant StatusFox a limited, non-exclusive licence to process and store your data for the purpose of providing the Service to you.

StatusFox may use aggregated, anonymized data derived from service usage for the purpose of improving the Service, conducting research, and publishing general industry benchmarks. This data will not identify you or your monitored endpoints individually.

Termination

You may stop using the Service at any time. If you have a paid subscription, you may cancel your account through your account settings.

StatusFox reserves the right to suspend or permanently terminate your access to the Service if you violate these Terms, particularly the Acceptable Use Policy. We may also terminate accounts that have been inactive for an extended period with reasonable advance notice.

Upon termination of your account, the following applies:

• Your account data will be retained for 30 days after termination, after which it will be permanently deleted.
• You may request immediate deletion of your data at any time by contacting us at privacy@statusfox.app.
• Access to the Service will be disabled immediately upon termination.

The following sections survive termination of these Terms: Limitation of Liability, Disclaimer of Warranties, Intellectual Property, and Governing Law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Czech Republic, except where mandatory consumer protection laws of your country of residence apply.

If you are a consumer resident in the European Union, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence that cannot be derogated from by contract.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr which EU consumers may use to resolve disputes with EU traders.
